COMELEC: Barangay and SK Election may be won via a toss coin

Comelec confirmed that the recent Barangay and Sangguniang Kabataan (SK) Election may be won via a toss coin, as published at ABS-CBN news on Tuesday.

According to the news, the Commission on Elections (Comelec) said that the Barangay and SK election may be won through a toss coin in case the tie vote occurs.

A classic example note by Comelec was the election for Barangay Chaiman for Turac in San Carlos City, Pangasinan, where the news reported that two candidates had 573 votes each.

As posted at ABS-CBN, Comelec said that candidates with equal number of votes may be favored by luck.

Under Section 71 of Comelec Resolution 9030, a poll race resulting in a tie “shall, by resolution, and upon five (5) days notice to all candidates concerned, hold a special public meeting in which the [Barangay Boards of Canvassers] shall proceed to the draw lots between the candidates who have tied and proclaim as election the candidates who may be favored by luck…”

With this, Reynante Castañeda and Socrates Bolatao, who were both running for Barangay Chairman of Turac, and apparently had 573 votes each, may proceed to the toss coin decision, a Comelec official told ABS-CBN.

However, Castañeda was reported to have been objecting with the election results and claims that he was 2 votes ahead of Bolatao.

On the other hand, local Comelec canvassers were said to have counted 2 contested ballots.

With this, Comelec and the city mayor gave an ultimatum to Castañeda and that he should agree to end the election result via toss coin, the news said.

“Gumawa kami ng notice, kailangan niyang pirmahan iyan,” (We already made a notice, and he should sign it) San Carlos City Comelec officer Gloria Cadiente told the news, who also happens to be a lawyer.

Meanwhile, a similar case in Barangay Mabini, also in San Carlos City was said to have happened during this SK election.

A certain Maria Liza Estabillo won the luck of the draw and was announced as the new SK chairperson of that barangay, according to ABS-CBN news.
